Gangtok, January 15: State Congress party president, Nar Bahadur Bhandari today underlined that the approval of the state government on CBI inquiry can be bypassed by the later with he mentioned that the consent of state government is not needed for CBI to invade state for any sort of inquiry. Speaking in same line, the SPCC president mentioned that the probe agency has no bar in investigating upon Chamling and others disproportionate assets case.

Referring to the Supreme Court of India verdict on February 2010, Bhandari said – “the unanimous verdict of a five judge Constitutional Bench headed by chief justice KG Balakrishnan came up with strict guidelines stating that the probe agency should be used in exceptional and extraordinary circumstances in cases having national and international ramifications”.
It is to be mentioned that the very verdict came on a bunch of petitions by the West Bengal government and some others who contended that the CBI can conduct a probe in any state only with prior consent of the government concerned under the provisions of the Delhi Special Police Establishment Act.
Indexing news reports published in a national news paper on February 18, 2010, Bhandari informed that on affect of the above mentioned judgment high court of West Bengal has ordered a CBI probe into the alleged killings of 11 Trinamool Congress workers at Midnapore, West Bengal.
“CBI did inquiry on the base of the mentioned judgment even when the Bengal state government had contended that if court order a CBIprobe, it would amount to a violation of the Delhi Police Establishment Act Section 6 of the Act provide that CBI cannot investigate a cognizable offence without the prior consent of the state concerned”, he added.
“If the CBI has no bar on the neighboring state West Bengal what has upheld the agency from invading Sikkim for Chamling’s and other disproportionate assets inquiry. Sikkim is the 22nd state of India and the state government should act accordingly”, he tagged.
Bhandari further informed of a SPCC campaign at Singtam on January 21.

    Every individual Sikkimese would have agreed and voted for the veteran leader Mr. Bhandari accordingly if
    1. The current rate of development in the state of Sikkim would have been same during his regime?
    2. If there still prevailed undemocratic means as during his regime to lure people and get their support or votes?
    3. If every village houses was still the Kuccha Houses?
    4. If every aspiring students of Sikkim had to go out of the state of Sikkim to continue their further studies like the MBBS, Engineering, Diploma, PhDs etc. like the case under his leadership?
    5. If Gangtok, Namchi, Jorethang and other towns in the state was still posed a dirty looks filled with lot of unorganised traffic and potholes as during his tenure of CM of Sikkim?
    6. If every individual had to go out of Sikkim for medical treatment because of the absence of world class hospitals and well equipped staffs (Manipal, CRH)?
    7. If there was a mass scale unemployment in the state.
    8. If all the central scheme like the SSA, NRHM, MG-NEGRA etc. Would have been in papers only as in case of his regime.

    10. If a platform like VoiceofSikkim to share and speak against the government and the Chief Minister would have been long scrapped.
    All of us would have certainly agreed to whatever stories Shri. Bhandari had to cook in order to fool the people. But for your kind information that all the Sikkimese people are not the same as during 80’s and 90’s now. We can make a difference between right and wrong, between commitment and false assurance. Mr. N.B Bhandari does not stand any comparison with that of Mr. Pawan Chamling because Mr. Chamling has put up lots of hard work and efforts to uplift the standard of Sikkim and the people as a whole. We feel more independent as of now than during Bhandari rule. We can practise all our fundamental rights given by our Constitution which was merely subjected to books as during Bhandari regime. “We are now Sanu Sikkim but Jaagako Sikkim” and Shri Bhandari has to know this truth.
